MOT run out, can't get in until Fri..

I am not 100% Dark Storm, i seem to think you get 2 weeks grace to sort things out, but dont take my word for it.

It had its exhaust replaced today, the guy said it was the original one! The cars a W reg, and is the best he's seen in along time! Only just done 50,000 miles:happy:
Oh am a bit annoyed about the wait til fri... trying to get oh to get it done sooner, as I don't want to spend 4 days of my fortnight off with no car! GRRRRRR..
 
The law say's you can legally drive it to an MOT that has already been booked in and that they can confirm,AFAIK you cannot even drive it for work to be done etc.If it needs work doing then it must stay at the garage until it is completed and a new MOT certficate is issued.I am not 100% about this as is OH's area rather than mine,but am pretty sure it's something along those lines.

They now have the ability to check if a car has an MOT without having to pull you over and ask etc,as all MOT's records are now held on a central database that garages have to enter all info in at time of car coming in for MOT,so if you drive it now or if it fails and you drive it away they will know!!

Also makes your insurance invalid,so TBH probably not worth the risk of driving it for the sake of waiting until friday.Pain in the butt I know,but better to play it safe I would think.

however you are allowed to drive home from a failed mot also.

but thats the rules.

without a valid mot no other driven rules apply legally.

it would need to be towed to a garage for work for example.
 
Trouble is that it will invalidate your insurance if you don't have a valid MOT. And I don't think you'd want to have an accident with no insurance....

I don't think that this is strictly true. You'd need to check your individual policy (in the very small print) and I'd need to just double check this with my OH. But my understanding is that if you drove the car without an MoT it would be the insurance companies responsibility to prove that the car was not roadworthy on the day of the accident. The MoT does not actually prove this it only proves that the car was roadworthy on the day of the test. For example you get an MoT on the Monday and then on following Monday your brakes seize up and fail does that mean that the car is roadworthy because you have a valid MoT certificate? No of course not, so therefore the insurance company must prove that between the day of the test and the day of the accident something happened to make the car unroadworthy. I hope that this makes sense.

I think you can drive to a pre-booked MoT test without Tax or MoT but you must have insurance. If it fails you can drive it away from the test centre, I think this is because historically it was a specialised centre rather than garage that used to do the test so you needed to be able to take a failed vehicle to a garage to get repairs done etc.

I'll double check this with my OH when he gets home from work though.

Oh, and I looked at the MOT website.. the list of what they check is as long as my arm!
 
Yay!! It's always a relief!

Ignorance of the law is no excuse.... however, I didn't realise that an MOT expired and I drive my Freelander around for 2 months before my Mum kicked my arse to get it done.

At that point I was pooping my pants!

Apparently, they no longer have to pull you over, all the garages that do MOT have to enter it on a massive database.. THEY KNOW EVERYTHING!! :eek:

Glad you got yours done.. I don't drive so don't understand all these laws and things.... :rolleyes:
